Hazmat Line Terms and Conditions of Service

Please read these Terms and Conditions ("Agreement") carefully before using Hazmat Line services. By registering or using our services, you agree to be bound by this Agreement.
1. Service Scope
Hazmat Line provides 24/7 hazardous materials (hazmat) emergency response via phone, primarily for shippers, carriers, and related parties involved in the transportation of dangerous goods. We do not offer regulatory consulting, SDS authoring, or onsite response services.
2. Acceptance of Terms
You accept this Agreement if you:
- Register for our service online.
- Display or distribute the Hazmat Line emergency phone number.
- Submit Safety Data Sheets (SDS) to Hazmat Line.
- Make a payment to Hazmat Line.
3. Service Limitations
Hazmat Line's role is limited to phone-based response support. We do not act as a regulatory agency or legal advisor, nor do we guarantee regulatory compliance or interpretation accuracy. We are not responsible for onsite activities, clean-up outcomes, or third-party actions unless explicitly agreed upon in writing.
4. No Warranty
Hazmat Line provides services "as-is" and disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant the accuracy or completeness of information shared during emergency calls.
5. Limitation of Liability
IN NO EVENT SHALL HAZMAT LINE OR ITS AFFILIATES BE LIABLE FOR DAMAGES EXCEEDING THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
This includes indirect, incidental, punitive, special, or consequential damages, lost profits, delays, or business interruptions—even if advised of such potential damages.
6. Indemnification
You agree to indemnify and hold harmless Hazmat Line and its personnel from any claim, liability, or loss (including legal fees) resulting from:
- Your use or misuse of our service
- Incidents involving third parties
- Use of incorrect or outdated data
- Regulatory actions taken against your company
7. Data and Communication
You are solely responsible for maintaining accurate SDS, contact, and product data. Hazmat Line is not liable for delays, errors, or miscommunications arising from incomplete or outdated information.
8. Automatic Renewal and Refunds
Subscriptions automatically renew annually unless canceled in writing before renewal. No refunds are issued once service has commenced, except in cases where Hazmat Line terminates without cause.
9. Termination
You may cancel service at any time. However, if terminated during an active service term, the full annual fee remains due. Hazmat Line reserves the right to terminate service with 30 days' notice. Upon termination, you must stop displaying or using Hazmat Line contact information.
10. Intellectual Property
All Hazmat Line content, tools, and trademarks remain our exclusive property and may not be reproduced, altered, or distributed beyond the scope of your service agreement.
11. Governing Law
This Agreement is governed by the laws of the State of Delaware. Any legal dispute will be resolved in courts located within that state.
12. Dispute Resolution
Before initiating legal action, both parties agree to engage in good-faith efforts to resolve disputes amicably. Services will continue during the resolution process unless otherwise instructed.
13. Force Majeure
Hazmat Line shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, cyberattacks, telecom disruptions, or regulatory action.
14. Third-Party Services Disclaimer
While Hazmat Line may assist in identifying or referring clean-up providers or external resources, we are not responsible for their actions, pricing, performance, or regulatory compliance. You assume full responsibility when engaging third parties.
15. Regulatory Interpretation Disclaimer
Information provided by Hazmat Line does not constitute legal or regulatory advice. You remain solely responsible for your company's regulatory compliance and any filings or submissions required.
16. Delayed Access Disclaimer
Hazmat Line is not responsible for any delay in emergency response caused by late or incomplete data submissions, such as SDSs, product profiles, or contact details.
17. Changes to Terms
Hazmat Line reserves the right to modify these Terms and Conditions at any time, in its sole discretion. Updates will be posted to our website with the revised effective date. Continued use of the service after such changes constitutes acceptance of the updated terms.
